Personal injury law firm Murphy & Prachthauser recently won a Wisconsin Supreme Court case that reinforced the Collateral Source Rule for uninsured or underinsured motorist coverage. The court ruled on March 7 that the plaintiff, Linda Orlowski, was allowed to recover the reasonable value of her medical services?including those amounts that were written off by the medical provider?for her underinsured motorist claim with State Farm Mutual Automobile Insurance Co.
The conclusion of Orlowski v. State Farm (2009AP2848,2012 WI 21) before Wisconsin?s highest court is a significant case with broad potential impact. The ruling will apply to the hundreds of underinsured motorist cases pending in Wisconsin, as well as?by implication?all uninsured motorist cases, according to Attorney Keith Stachowiak, of the law firm of Murphy & Prachthauser s.c., who represented the plaintiff. ?This case put an end to a rule that permitted an insurance company to limit the amount it was required to pay to policy holders?under both uninsured and underinsured motorist coverages in Wisconsin?for medical expenses policy holders incurred to treat their injuries,? said Stachowiak, the Milwaukee auto accident lawyer who authored the Wisconsin Supreme Court brief and made an oral argument before the court in late January 2012. Kevin Kukor and Josef Zimmerman of Murphy & Prachthauser also participated in the case.
The case represents a reaffirmation by the Wisconsin Supreme Court of an important principal of law known as the Collateral Source Rule, according to Stachowiak. Traditionally, under the collateral source rule, a defendant couldn?t seek to reduce its liability by introducing evidence that the plaintiff had received compensation from other sources, such as the plaintiff’s own insurance coverage. This ensured that a person responsible for injuring someone in an auto accident could not get off the hook by claiming he didn?t have to pay the injured party?s medical expenses or lost wages because the injured person had health insurance or an employer continued to pay his wages when he missed work. The amount a negligent person owed would not be reduced because of payments made by the injured person?s health insurance or employer.
The Collateral Source Rule applied to all auto accident cases until 2001, when the Wisconsin Court of Appeals held in Heritage Mutual Insurance Co. v. Graser (2002 WI App 125, 254 Wis.2d 851,647 N.W.2d 385) that it would no longer apply to uninsured and underinsured motorist claims. After that, insurance companies began agreeing in uninsured or underinsured motorist claims to compensate injured parties only for the amount their health insurance paid?not the amount their doctors charged.
Stachowiak says the March ruling is long-overdue vindication for Orlowski, who was not satisfied with $ 11,498 in medical expenses previously awarded by an arbitration panel (2012 WI 21, Paragraph 2) for damages resulting from an auto accident several years ago. The reasonable value of Orlowski?s medical services was $ 72,985, and her medical provider chose to write off/waive $ 61,487. Arbitrators decided to award Orlowski only the difference between the two amounts?$ 11,498. So Orlowski sued in the Milwaukee County Circuit Court (2009-CV-002601) for a modification of the award. Ultimately, the court sided with Orlowski and modified the award to include the written-off figure, which required State Farm to reimburse her for $ 61,487. State Farm appealed the decision, and the case was elevated to the state supreme court for resolution.
The Wisconsin Supreme Court?s unanimous March ruling is the final word on Orlowski?s right to receive the full reasonable value of the written-off medical expenses in her underinsured motorist case. It created a blanket directive that the Collateral Source Rule applies to an injured part?s underinsured motorist action. It begins on Friday, August 24, 2012 and ends on Sunday, August 26, 2012. We will also participate in the Veterans for Ron Paul march during the start of the Republican National Convention on Monday, August 27, 2012, after which we will head home.Which Ronvoy route should I choose?Travelers should register for the route that has the city you will depart from on it. So if you're coming from Long Beach, you'll depart in LA at the airport. You will depart from the home city on either August 22nd or 23rd, depending upon which city you are departing from, arrive in Tampa on the 24th…enjoy the weekend of events…then depart for home on the 27th after the Veterans march, arriving back home on either the evening of the 28th or the morning of the 29th, depending upon how far away the original departure city is.How is the rate for a particular Ronvoy route determined?Revolution Travel Management is an entirely non-profit travel & lodging brokerage. Our Committee volunteers are not paid for their service of coordinating travel & lodging for liberty events. They do it because they believe in the cause. Travelers pay the EXACT amount per person for each vehicle and for fuel.There is no trick to this. Revolution Travel Management contracts with various car rental agencies through the nation, including Avis, Budget and others. We are able to reserve bulk amounts of vehicles at the lowest rate possible. We divide the total cost of the vehicle, including the rent fee, insurance and tax, by the number of passengers on the vehicle.We then calculate the cost of fuel for the route. Starting from the original departure city, we determine the total mileage to Tampa and back. We divide that by the miles per gallon of the vehicle (15mpg). After computing the amount of gallons of fuel required, we multiply that number by per gallon. We take that total cost of fuel and divide it by the number of passengers per vehicle on the route. Approximately one week prior to the driver's departure date, we transfer the fuel funds to him directly. He then holds complete responsibility for paying for the fuel for the Ronvoy from that point forward.Note: Some routes may encounter toll fees. Travelers are asked to share in the responsibility of paying these fees throughout travel. Where possible, RTM has coordinated routes avoiding tolls as much as possible, while reasonably coordinating a route that is the most direct route to Tampa.*Yes, we know fuel isn't per gallon EVERYWHERE, but in the major cities it is getting close – we don't want to cut ANY vehicle short of fuel. Any minute amount of fuel money that may be left over is given to the driver who picked up the vehicle, for his dedicated service to the cause of liberty, at the end of the trip.How does the Ronvoy work?The vehicles hold 12 or 15 people each. We sell the spots to twelve or fifteen people per vehicle per route. Once all the spots on a particular vehicle have been sold on a route, we pay for the vehicle directly from the Revolution Travel Management account with traveler funds. Ronvoy vehicles are driven by volunteer drivers who are also paid travelers on the route. Revolution Travel Management transfers the TOTAL amount of money required for fuel for the entire route to the driver in advance of the departure date. The driver agrees to be responsible for picking up the vehicle at the correct time and to travel the route as required to pick up all travelers who have been assigned to his or her vehicle. The driver communicates with his Ronvoy route coordinator (the volunteer who is organizing the passengers into vehicles for that route) regarding specific pickup locations in each city.
Driver Information:Qualified Drivers are required for every Ronvoy route vehicle. A qualified driver will be at least 25 years of age, with a valid drivers license.
If ticket purchaser will be a driver and is qualified, please indicate so on registration form when paying for ticket. Drivers are responsible for ensuring timely and safe travel for all passengers. Revolution Travel Management does not require a DMV check, however the vehicle companies we contract through may do so at vehicle pick-up.
Drivers are responsible for communicating with the Ronvoy coordinator with any unanticipated changes throughout travel.

Traveler Information:
Drivers will be provided with all confirmed and paid traveler's contact information. Driver information will be provided to all travelers on August 1, 2012. It is the traveler's responsibility to contact the driver directly with any questions or concerns regarding travel.
It is the traveler's sole responsibility to arrive at the departure location on time in the pick-up city, as well as at the departure location for shuttles provided to and from Tampa. Travelers are encouraged to arrive at least thirty minutes early for departure. Travelers are expected to communicate with the driver on issues regarding schedule. Drivers will be in contact with travelers to confirm departure location and estimated arrival time.
There are NO REFUNDS for being late/missing the departure of the Ronvoy. It is ABSOLUTELY in the best interest of the traveler to be in contact with your driver regularly. Unless route is cancelled due to low participation, all sales are FINAL.
Vehicle Information:
Vehicles are 12 and 15 passenger vans – NOT buses. RTM utilizes passenger vans for several reasons:
1. This allows travelers to be flexible in their travel – stop to eat, use the restroom, stretch at leisure.
2. This allows travelers to have transportation to and from all the events in Tampa.
3. Rather than using personal vehicles, we utilize rental vehicles so that in the event of mechanical error, travelers are ensured that the company will get them back on the road.
Luggage space WILL BE LIMITED! Travelers are encouraged to pack ONE BAG only. Come on! No one's going to care what you look like at a Ron Paul event! In addition to your bag, we recommend a pillow. For those travelers who are tent camping, please try to consolidate your camping equipment as much as possible, i.e. roll your tent inside your sleeping bag if possible. Please be courteous to your fellow liberty-loving travelers.
